1. Agreement to Terms

These Terms of Use ("Terms") constitute a binding agreement between you and KangiApp ("Company", "we", "our", or "us") regarding your use of the KangiApp mobile application ("App"). By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree with any part of these Terms, you must not use the App. These Terms are effective as of February 2026 and may be updated periodically. Your continued use of the App following any amendments constitutes your acceptance of the modified Terms.

2. Use License

We grant you a limited, non-exclusive, non-transferable, and revocable license to download and use the KangiApp application solely for your personal, non-commercial fitness and wellness purposes. This license does not permit you to:

  • Modify or copy the App or any of its content
  • Reverse engineer, decompile, or disassemble the App
  • Remove or alter any proprietary notices or labels on the App
  • Transfer or sublicense the App to another person or entity
  • Use the App for any commercial purpose or competitive analysis
  • Sell, resell, or rent the App or access to the App

3. User Restrictions and Prohibitions

When using KangiApp, you agree not to:

  • Violate Laws: Use the App in violation of any applicable federal, state, local, or international law or regulation
  • Harmful Content: Upload, post, or transmit any content that is illegal, defamatory, abusive, obscene, or harmful
  • Infringement: Infringe upon or violate the intellectual property rights or privacy of others
  • Disruption: Attempt to disrupt, interfere with, or damage the functionality or security of the App
  • Unauthorized Access: Attempt to gain unauthorized access to the App, user accounts, or related systems
  • False Information: Provide false, misleading, or fraudulent information during account registration or use
  • Harassment: Engage in any form of harassment, bullying, or threatening behavior toward other users
  • Spam: Send unsolicited messages, advertisements, or promotional content through the App

4. Disclaimer of Warranties

EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS, KangiApp IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability: The App is fit for a particular purpose or merchantable
  • Accuracy: The content, features, and functionality are accurate, error-free, or uninterrupted
  • Security: The App is secure or free from viruses, malware, or other harmful components
  • Medical Advice: The App provides medical diagnosis, treatment, or professional health advice

You use the App at your own risk. Before beginning any new fitness regimen, consult with a qualified healthcare professional. The App is designed to complement, not replace, professional medical advice.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KANGIAPP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL KANGIAPP'S TOTAL LIABILITY FOR ALL CLAIMS arising out of or relating to these Terms or your use of the App EXCEED THE AMOUNTS PAID BY YOU TO KANGIAPP, IF ANY, IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

6. Intellectual Property Rights

All content, features, and functionality of the KangiApp, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and data compilation, are the exclusive property of KangiApp or its content suppliers and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any content you create or upload through the App (such as workout photos or personal fitness notes), but you grant KangiApp a worldwide, royalty-free license to use, reproduce, modify, and display such content for operational and analytical purposes.

You may not use, copy, modify, or distribute any content from the App without our express written permission.

7. Termination

KangiApp may terminate or suspend your access to the App immediately, without notice or liability, for any reason, including if you violate these Terms. Grounds for termination include but are not limited to:

  • Violation of any provision of these Terms
  • Misuse of the App or its features
  • Engagement in illegal or harmful activities
  • Multiple violations of our community standards or policies

Upon termination, your right to use the App ceases immediately. Any provisions that by their nature should survive termination shall do so.

8. Modifications to Service

KangiApp reserves the right to modify, suspend, or discontinue the App or any service or feature at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the App or any service or feature.

We may also make improvements and changes to the App at any time. These changes may include updates, patches, bug fixes, new features, or changes to existing functionality. While we will use reasonable efforts to maintain the App's functionality, we do not guarantee that all features will remain available or unchanged.

These Terms of Use are governed by and construed in accordance with the laws of the jurisdiction in which KangiApp is incorporated, without regard to its conflicts of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in that jurisdiction.
